New UK Visa Rules (8 Oct): How Changing Your Application Could Make You an Overstayer

As a leading IAA regulated firm and a trusted Nepali immigration advisor in the UK, we frequently manage diverse applications where timing is everything. For many individuals and Nepalese families navigating the Home Office system, submitting a fee waiver request is a critical first step. When a client's visa is nearing expiration and they cannot afford the standard fees, requesting a waiver triggers Section 3C leave. This vital safety net freezes their status, keeping them legally in the UK while the Home Office reviews their financial situation.

Historically, the wording of Paragraph 34G(4) contained a procedural loophole. Some applicants would submit a fee waiver request for one immigration route simply to secure Section 3C protection, and later vary (switch) their pending application to a completely different visa route. Following the Upper Tribunal’s reported decision in R (Hussain) v SSHD UKUT 00082 (IAC), they could legally argue that the application date for their new route should still backdate to the day they first requested the fee waiver.

The Home Office is officially closing this loophole on 8 October 2026.

How the New Rules Impact Your Application

The updated rules drastically change how fee waivers interact with Section 3C leave. If you are navigating this process, you must be aware of three critical changes to timing and procedure:

  • The Route Must Match: To keep your Section 3C protection active from the date of your initial fee waiver request, your eventual visa application must be for the exact same immigration route.
  • Changing Routes Will Reset Your Application Date: If you request a fee waiver for one route (such as a partner or spouse visa) but later decide to apply under a different route (such as a Skilled Worker visa), your application date resets. It will count strictly from the day you submit the new visa application. If your original visa expired while you were waiting for the fee waiver decision, your Section 3C leave will instantly break, making you an overstayer.
  • Paid Applications are Safeguarded (If the Route Matches): If you decide you can no longer wait for a fee waiver decision and choose to pay the application fee out-of-pocket, the Home Office will still recognize your initial fee waiver request date as your official application date—but only if you remain on the exact same visa route.

No Extra Time for Biometrics (Paragraph 34BB(2A))

The changes also tighten rules around biometric enrolment. Previously, varying an application reset the clock for submitting your fingerprints and photos. From 8 October, switching your application type will not give you a fresh biometric deadline. You must adhere strictly to the timetable set by your very first application. Missing this original window risks your application being rejected entirely.

Things to Know

The 10-working-day window to submit your application after a fee waiver decision remains in place, but your margin for error has disappeared. Because varying to a different route will now destroy your backdated application date and jeopardize your Section 3C protection, you cannot afford to change your mind mid-process. Before submitting a fee waiver request, you must be entirely certain that you qualify for, and intend to follow through with, that specific visa route.
